Terms of Service

Accounts are for school staff, administrators, and parents/guardians invited by a school. You must provide accurate information, keep credentials confidential, complete required multi-factor authentication, and notify us promptly of any unauthorized access. You are responsible for activity under your account.

If you enter student data, you represent that you are authorized by your school or district to do so and that the school has provided any notice or obtained any consent required by FERPA, COPPA, or state law. Schools direct how their data is used, retained, and deleted.

• Do not access records you have no legitimate educational interest in.
• Do not share accounts, credentials, or kiosk launch links outside their purpose.
• Do not attempt to bypass access controls, scrape data, or probe the service without written permission.
• Do not upload unlawful, infringing, or malicious content.
• Do not use the service to make high-stakes decisions about a client without professional review of the results.

Report drafting is AI-assisted. Drafts are suggestions only, may contain errors, and are not diagnostic or clinical determinations. A qualified educator must review and edit every draft before it is saved, shared, or relied on.

Schools retain all rights to the data they enter. We claim no ownership of student records. We use customer data only to provide and support the service as described in our Privacy Policy. We may use aggregated, de-identified statistics that cannot reasonably identify a student or school to improve the service.

We work to keep the service available but do not guarantee uninterrupted operation. Maintenance, updates, and feature changes may occur. We will give reasonable notice of changes that materially reduce core functionality.

Paid plans are billed as stated in your order or subscription page. Fees are non-refundable except where required by law or expressly agreed in writing. Free or trial access may be modified or ended at any time.

You may stop using the service at any time. We may suspend or terminate access for non-payment, violation of these terms, or risk to other users or student data. On termination, we retain data for 90 days so the school can export it, then delete or de-identify it unless the school directs otherwise or law requires longer retention.

Except as expressly stated, the service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Assessment results are educational tools, not medical, psychological, or legal advice.

To the maximum extent permitted by law, Better Answers Inc. is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the amounts you paid us for the service in the twelve months before the event giving rise to the claim.

You agree to indemnify Better Answers Inc. against claims arising from your misuse of the service, your violation of these terms, or your failure to obtain required consents for student data you enter.

These terms are governed by the laws of the State of Nevada, without regard to conflict of law rules. The exclusive venue for disputes is the state or federal courts located in Clark County, Nevada. Public-school customers may substitute the governing law required by their own jurisdiction in a signed agreement.

We may update these terms and will post the revised version here with a new date. Continued use after the change takes effect means you accept the updated terms.
